Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using Chupke ("the App," "the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Chupke. We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years of age to use Chupke. We do not knowingly collect personal information from users under 18. If we learn that we have collected information from a user under 18, we will promptly delete it and terminate the associated account.

By using Chupke, you represent and warrant that you meet the eligibility requirements stated above and that you have the legal capacity to enter into these Terms.

3. Description of Service

Chupke is an anonymous messaging and social gaming platform. The Service includes, but is not limited to:

  • Mystery Messaging: Send and receive anonymous messages ("mysteries") where receivers investigate clues to guess the sender's identity
  • Investigation System: A clue-based investigation room with 22 named clues, a suspect board, certainty bar, and pressure test mechanics
  • The Vault: Squad-only anonymous confessions where squad members try to guess the author
  • The Unsent: A public anonymous feed where users post confessions and others investigate writing signals
  • Handshake: A mutual identity reveal system using a 4-digit code exchange
  • Out of the Shadows: A feature allowing mystery senders to voluntarily reveal their identity to the receiver
  • Real-time Chat: Direct messaging with GIF search, emoji reactions, and customizable chat themes
  • Squads & Squad Wars: Group features including weekly XP leagues and squad competitions
  • Progression System: XP, 10 detective ranks (Rookie to Mythic), levels, daily streaks, and streak freezes
  • Cosmetics Store: Animated avatar frames and mystery card skins purchasable with in-app currency
  • Subscriptions: PRO and GHOST premium subscription tiers with enhanced features

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time without prior notice.

4. Account Registration & Security

To use Chupke, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security and confidentiality of your login credentials
  • Not share your account with others or create multiple accounts
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

You may choose a username that will be visible to other users. Usernames must not impersonate other individuals, contain offensive language, or violate any third-party rights.

5. User Conduct

You agree not to use Chupke to:

  • Send threatening, harassing, abusive, or intimidating messages
  • Engage in bullying, cyberbullying, or targeted harassment of any individual
  • Share personal or private information of others without their consent (doxxing)
  • Post or send hate speech, content promoting discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Send sexually explicit or pornographic content, especially to minors
  • Promote or glorify self-harm, suicide, or violence
  • Spam, send unsolicited commercial messages, or engage in phishing
  • Attempt to circumvent safety, moderation, or security systems
  • Use bots, scripts, or automated tools to interact with the Service
  • Reverse-engineer, decompile, or disassemble any part of the App
  • Exploit bugs or vulnerabilities rather than reporting them
  • Impersonate another user, public figure, or Chupke staff
  • Use the platform for any illegal purpose or in violation of any applicable laws

Violations of these rules are subject to enforcement actions as described in Section 9 (Content Moderation). For detailed guidelines, please review our Community Guidelines.

6. Anonymity & Its Limits

Chupke provides anonymous messaging features where the sender's identity is concealed from the receiver. However, anonymity on Chupke is not absolute:

  • We maintain internal records of sender identities for safety, moderation, and legal compliance purposes
  • We may disclose sender information in response to valid legal requests, court orders, or subpoenas
  • We may reveal sender information when we believe in good faith that disclosure is necessary to prevent imminent physical harm, protect the safety of any person, or prevent illegal activity
  • Features like "Out of the Shadows" and "Handshake" allow voluntary identity reveals by the sender
  • The investigation system provides clues that may allow a receiver to correctly guess the sender's identity — this is an intentional part of the game

By using Chupke, you acknowledge that anonymity is a game mechanic and not a guarantee of permanent concealment.

7. Content Ownership & License

You retain ownership of the content you create and share through Chupke (messages, confessions, profile information). However, by submitting content to the Service, you grant Chupke a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, and display your content solely for the purpose of operating, developing, and improving the Service.

You represent that you have the right to share any content you submit, and that your content does not infringe upon the intellectual property rights, privacy rights, or other rights of any third party.

We reserve the right to remove any content that violates these Terms or our Community Guidelines without prior notice.

8. In-App Purchases & Subscriptions

Subscriptions: Chupke offers PRO and GHOST premium subscription tiers. Subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to the billing terms of the respective app store. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

Virtual Currency (Coins): Chupke uses an in-app virtual currency called "Coins." Coins can be earned through gameplay (solving mysteries, streaks, etc.) or purchased with real money. You acknowledge that:

  • Coins have no real-world monetary value and cannot be exchanged for cash
  • Coins are non-transferable between accounts
  • Purchased Coins are non-refundable except where required by applicable law
  • We reserve the right to modify Coin pricing, earning rates, and spending rates at any time

Virtual Items: Cosmetic items (avatar frames, card skins, streak freezes) purchased with Coins are virtual goods with no real-world value. They are licensed to you, not sold. We may modify, retire, or replace virtual items at our discretion.

Refunds: All purchases are processed by the Apple App Store or Google Play Store. For refund requests, please contact the respective app store directly. We do not process refunds independently.

9. Content Moderation

All user-generated content is subject to automated and manual content moderation. We use a three-strike system for policy violations:

  • Strike 1: Warning notification with explanation of the violation
  • Strike 2: Temporary account suspension (7 days) with restricted access
  • Strike 3: Permanent account ban

Severe violations (threats of violence, sharing of illegal content, or content depicting harm to minors) may result in an immediate permanent ban without prior warnings. We may also report such content to law enforcement authorities.

Moderation decisions can be appealed by contacting support@chupke.app. Appeals will be reviewed within 7 business days.

10. Blocking & Restricting Users

Chupke provides a blocking feature that allows you to prevent specific users from interacting with you. When you block another user:

  • The blocked user will be unable to send you mysteries, chat messages, or interact with you in any way through the platform
  • You will no longer see the blocked user's content (mysteries, Unsent posts, Vault confessions, search results) and they will not see yours
  • Any existing chat conversations between you and the blocked user will be suspended
  • Blocking is bidirectional in effect — once you block someone, neither party can see or contact the other
  • You may unblock a user at any time through your settings, which will restore mutual visibility and the ability to interact

Blocking does not delete any previously sent messages or content. It only prevents future interactions and hides ongoing visibility. We do not notify users when they are blocked or unblocked.

11. Intellectual Property

The Chupke name, logo, visual design, user interface, game mechanics, rank system, clue system, and all other elements of the Service are the intellectual property of Chupke and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any part of the Service without our prior written consent.

12. Third-Party Services

Chupke uses third-party services to operate the platform, including but not limited to:

  • Google Firebase: For authentication, data storage, real-time database, cloud functions, and push notifications
  • Apple App Store / Google Play Store: For app distribution and in-app purchase processing
  • GIF providers: For GIF search functionality within chat

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party services.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy, completeness, or usefulness of any content on the Service.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHUPKE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM:

  • Your use of or inability to use the Service
  • Any content or messages received from other users
  • Unauthorized access to your account or data
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any third-party content, services, or conduct

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to Chupke in the 12 months preceding the claim, or INR 5,000, whichever is greater.

15. Indemnification

You agree to indemnify, defend, and hold harmless Chupke and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Any content you submit through the Service

16. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms or our Community Guidelines.

Voluntary deletion: You may delete your account at any time through the app settings. Upon deletion:

  • Your profile, username, and public information will be removed
  • Your message history will be retained in anonymized form for the integrity of other users' mystery experiences
  • Any unused Coins or active subscriptions will be forfeited
  • Deletion is permanent and cannot be reversed

17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

18. Dispute Resolution

Before filing any formal legal claim, you agree to first contact us at support@chupke.app and attempt to resolve the dispute informally within 30 days. If the dispute cannot be resolved informally, either party may pursue legal remedies as provided under applicable law.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Community Guidelines, constitute the entire agreement between you and Chupke regarding your use of the Service and supersede all prior agreements and understandings.

21. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will notify you through the App or by other appropriate means. Your continued use of Chupke after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
